Terms of Service & SLA Agreement

1. Acceptance of Terms & Eligibility

By creating an account, linking a Git repository, accessing our APIs, or utilizing any cloud services provided by onrenderr Cloud Technologies Pty Ltd ("onrenderr", "we", "us", or "our"), you ("Customer", "User", or "Organization") agree to be bound by these Terms of Service, our Privacy Policy, Acceptable Use Policy, and Service Level Agreement (SLA).

If you represent an enterprise or corporate entity, you warrant that you possess full legal authority to bind that entity to these Terms under the Corporations Act 2001 (Cth).

2. Cloud Infrastructure & Service Provisioning

onrenderr provides automated cloud infrastructure hosting, including Web Services, Static Sites, Managed PostgreSQL, Managed Redis, Background Workers, and Private VPC Networks. Services are provisioned primarily in our Sydney (ap-southeast-2) datacenter region, with global edge routing across international nodes.

3. Billing, AUD Pricing & GST Compliance

All prices quoted on onrenderr are denominated in Australian Dollars ($ AUD) unless explicitly stated otherwise.

4. Acceptable Use Policy (AUP)

You agree not to use onrenderr servers or networks for any unlawful or malicious activities. Prohibited uses include, but are not limited to:

Violations of the AUP result in immediate account termination without refund and reporting to Australian Federal Police (AFP) or relevant law enforcement authorities where applicable.

5. 99.99% Service Level Agreement (SLA) & SLA Credits

onrenderr guarantees a Monthly Uptime Percentage of at least 99.99% for all paid Web Service instances, Enterprise clusters, and Managed Databases running in the Sydney (ap-southeast-2) region.

SLA credit claims must be submitted to support@onrenderr.com within 30 days of the recorded incident. Outages caused by scheduled maintenance (notified 48h in advance), upstream internet backbone failures, or AUP violations are excluded from SLA calculations.

6. Customer Data Ownership & Backup Responsibilities

Customer retains 100% ownership, intellectual property rights, and title to all code, data, database records, and digital assets deployed to onrenderr. We do not acquire any implied licenses or rights to customer code.

While onrenderr performs automated daily snapshots for Managed PostgreSQL and Redis instances, customers are strongly advised to maintain secondary offsite backups for mission-critical applications.

7. Limitation of Liability & Australian Consumer Law

To the maximum extent permitted by Australian law (including Schedule 2 of the Competition and Consumer Act 2010 (Cth)):

These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia. Any legal action, dispute, or proceeding arising under these Terms shall be submitted to the exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia located in Sydney.
